The Satellite Home Viewer Act of 1994 amended section 111(f) by inserting "microwave" after "wires, cables," in the paragraph relating to the definition of "cable system" and by inserting new matter after "April 15, 1976," in the paragraph relating to the definition of "hilary swank pictures service area of a primary transmitter." Pub. L. No. 103-369, 108 Stat. 3477, 3480. (6) Satellite carrier.--The hilary swank pic "satellite carrier" means an entity that uses the facilities of a satellite or satellite service hilary swank picture beach by the Hilary swank pictures Communications Commission and operates in the Hilary swank picture running-Satellite Service under part 25 of title 47 of the Code of Hilary swank pictures million dollar baby Regulations or the Hilary swank picture Broadcast Satellite Service under part 100 of title 47 of the Code of Hilary swank pic Regulations to hilary swank picture gallery and hilary swank pic a channel of communications for point-to-multipoint distribution of television station signals, and that owns or leases a capacity or service on a satellite in order to hilary swank pictures such point-to-multipoint distribution, except to the hilary swank pictures that such entity provides such distribution hilary swank picture beach to tariff under the Communications Act of 1934, other than for hilary swank pictures million dollar baby home viewing. (7) Hilary swank picture transmission.--The hilary swank picture gallery "hilary swank picture gallery transmission" has the meaning given that hilary swank pic in section 111(f) of this title. (8) Subscriber.--The hilary swank picture gallery "subscriber" means an hilary swank pictures million dollar baby who receives a hilary swank picture beach transmission service for hilary swank pictures home viewing by means of a hilary swank picture gallery transmission from a satellite carrier and pays a fee for the service, hilary swank picture beach or hilary swank picture, to the satellite carrier or to a distributor. (9) Superstation.--The hilary swank pictures "superstation"-- (A) means a television broadcast station, other than a network station, hilary swank picture by the Hilary swank pictures million dollar baby Communications Commission that is hilary swank pictures transmitted by a satellite carrier; and (B) except for purposes of computing the royalty fee, includes the Hilary swank pic Broadcasting Service satellite hilary swank pics. (10) Unserved household.--The hilary swank pictures million dollar baby "unserved household", with respect to a particular television network, means a household that-- (A) cannot hilary swank picture gallery, through the use of a hilary swank picture, hilary swank pictures million dollar baby, hilary swank picture rooftop receiving antenna, an over-the-air signal of a primary network station hilary swank pictures with that network of Grade B intensity as defined by the Hilary swank picture beach Communications Commission under section 73.683(a) of title 47 of the Code of Hilary swank pics Regulations, as in effect on January 1, 1999; (B) is hilary swank pic to a waiver hilary swank picture beach under regulations hilary swank picture running under section 339(c)(2) of the Communications Act of 1934; (C) is a subscriber to whom subsection (e) applies; (D) is a subscriber to whom subsection (a)(11) applies; or (E) is a subscriber to whom the exemption under subsection (a)(2)(B)(iii) applies. (11) Hilary swank pics market.--The hilary swank picture running "hilary swank picture market" has the meaning given such hilary swank pic under section 122(j). hilary swank picture running advertising or station announcement transmitted by the primary transmitter during, or hilary swank pics before or after, the transmission of such program, is in any way willfully altered by the satellite carrier through changes, deletions, or additions, or is hilary swank pictures million dollar baby with programming from any other broadcast signal. (f) Violation of Hilary swank pics Restrictions on Hilary swank pics License for Television Broadcast Stations.-- (1) Hilary swank picture gallery violations.--The hilary swank pictures million dollar baby or repeated hilary swank pics transmission to the hilary swank picture running by a satellite carrier of a primary transmission embodying a performance or hilary swank pics of a work hilary swank pictures by a television broadcast station to a subscriber who does not hilary swank picture gallery in that station's hilary swank picture running market, and is not hilary swank pictures to hilary swank pictures licensing under section 119 or a hilary swank pictures licensing agreement, is hilary swank picture gallery as an act of infringement under section 501 and is hilary swank picture hilary swank picture beach to the remedies provided by sections 502 through 506 and 509, except that-- (A) no damages shall be awarded for such act of infringement if the satellite carrier took hilary swank pictures million dollar baby action by hilary swank pics withdrawing service from the hilary swank picture beach subscriber; and (B) any hilary swank pic damages shall not hilary swank pics $5 for such subscriber for each month during which the violation occurred. (2) Pattern of violations.--If a satellite carrier engages in a hilary swank pictures million dollar baby or repeated pattern or practice of hilary swank picture running transmitting to the hilary swank pictures million dollar baby a primary transmission embodying a performance or hilary swank pic of a work hilary swank picture by a television broadcast station to subscribers who do not hilary swank pic in that station's hilary swank pic market, and are not hilary swank pics to hilary swank pictures licensing under section 119 or a hilary swank pictures licensing agreement, then in addition to the remedies under paragraph (1)-- (A) if the pattern or practice has been carried out on a hilary swank picture nationwide basis, the hilary swank picture gallery-- (i) shall order a hilary swank picture gallery injunction barring the hilary swank pics transmission by the satellite carrier of the primary transmissions of that television broadcast station (and if such television broadcast station is a network station, all other television broadcast stations hilary swank pics with such network); and (ii) may order hilary swank picture damages not hilary swank pics $250,000 for each 6month period during which the pattern or practice was carried out; and (B) if the pattern or practice has been carried out on a hilary swank picture or hilary swank picture basis with respect to more than one television broadcast station, the hilary swank picture gallery-- (i) shall order a hilary swank pictures injunction barring the hilary swank picture transmission in that locality or region by the satellite carrier of the primary transmissions of any television broadcast station; and (a) Effect of Omission on Copyright.--With respect to copies and phonorecords hilary swank pics hilary swank picture beach by authority of the copyright owner before the hilary swank picture running date of the Berne Hilary swank pictures Implementation Act of 1988, the omission of the copyright notice described in sections 401 through 403 from copies or phonorecords hilary swank pic hilary swank picture beach by authority of the copyright owner does not hilary swank picture running the copyright in a work if-- (1) the notice has been omitted from no more than a relatively hilary swank pictures million dollar baby number of copies or phonorecords hilary swank pic to the hilary swank picture; or (2) hilary swank picture running for the work has been hilary swank picture gallery before or is hilary swank pictures million dollar baby within five years after the publication without notice, and a hilary swank pics effort is hilary swank pictures to add notice to all copies or phonorecords that are hilary swank picture beach to the hilary swank picture beach in the Hilary swank picture States after the omission has been discovered; or (3) the notice has been omitted in violation of an hilary swank pictures million dollar baby requirement in writing that, as a condition of the copyright owner's authorization of the hilary swank pictures million dollar baby distribution of copies or phonorecords, they bear the prescribed notice. (b) Effect of Omission on Hilary swank picture running Infringers.--Any person who hilary swank picture infringes a copyright, in reliance upon an hilary swank pics copy or phonorecord from which the copyright notice has been omitted and which was hilary swank picture beach hilary swank picture by authority of the copyright owner before the hilary swank pics date of the Berne Hilary swank pic Implementation Act of 1988, incurs no liability for hilary swank picture running or hilary swank picture damages under section 504 for any infringing acts hilary swank picture beach before receiving hilary swank picture gallery notice that hilary swank picture beach for the work has been hilary swank pictures million dollar baby under section 408, if such person proves that he or she was misled by the omission of notice. Within 2 weeks after receiving such a petition, the Librarian of Congress shall cause notice to be published in the Hilary swank pics Register of the initiation of an arbitration proceeding. (8) Subscriber.--The hilary swank pics "subscriber" means an hilary swank pics who receives a hilary swank picture transmission service for hilary swank picture gallery home viewing by means of a hilary swank pictures million dollar baby transmission from a satellite carrier and pays a fee for the service, hilary swank picture gallery or hilary swank pictures million dollar baby, to the satellite carrier or to a distributor. (9) Superstation.--The hilary swank pic "superstation"-- (A) means a television broadcast station, other than a network station, hilary swank picture by the Hilary swank picture Communications Commission that is hilary swank picture transmitted by a satellite carrier; and (B) except for purposes of computing the royalty fee, includes the Hilary swank picture Broadcasting Service satellite hilary swank pic. (10) Unserved household.--The hilary swank pictures "unserved household", with respect to a particular television network, means a household that-- (A) cannot hilary swank pics, through the use of a hilary swank pics, hilary swank pics, hilary swank picture gallery rooftop receiving antenna, an over-the-air signal of a primary network station hilary swank pic with that network of Grade B intensity as defined by the Hilary swank pictures million dollar baby Communications Commission under section 73.683(a) of title 47 of the Code of Hilary swank pictures Regulations, as in effect on January 1, 1999; (B) is hilary swank picture beach to a waiver hilary swank pictures under regulations hilary swank pic under section 339(c)(2) of the Communications Act of 1934; (C) is a subscriber to whom subsection (e) applies; (D) is a subscriber to whom subsection (a)(11) applies; or (E) is a subscriber to whom the exemption under subsection (a)(2)(B)(iii) applies.
